The singer and her mother, Georgina Marquez Kelly, accuse L.A.-based Ark Music Factory of copyright infringement and unlawful exploitation of publicity rights.

“Friday” singer Rebecca Black and her mother, Georgina Marquez Kelly, are accusing the L.A.-based record label Ark Music Factory of copyright infringement and unlawful exploitation of publicity rights, according to Rolling Stone.

Black’s and Kelly’s lawyer, Brian Schall, sent a letter to Ark on March 29 outlining the argument. The letter reportedly asserts Marquez Kelly signed an agreement with Ark in November that grants Black complete ownership of “Friday,” but the company has yet to provide her with the master recordings of the song or the music video. According to Rolling Stone, Kelly paid $4,000 to produce the song, not the $2,000 that has been widely reported.

Ark exploited Black’s likeness and song and created an unauthorized “Friday” ringtone, the letter reportedly continues. It also claims that Ark was advertising Black as an exclusive artist on their website, but she has since been removed from that section; banner ads on the homepage instead promote “Butterflies,” a song by Ark artist Alana Lee.

Ark Music Factory founder Patrice Wilson denied most of the letter’s allegations, saying, “I have met with Rebecca Black’s mom and everything is fine. She will get the masters and the song. They can have it all.”

But Barry Rothman, Ark’s lawyer, said the agreement Kelly signed in November was not court-approved, so Kelly in fact does not own the rights to “Friday.”

Clarence Jey, Wilson’s partner at Ark Music Factory, said that Ark promoted Black and distributed her song with Kelly’s consent, until “Friday” started earning real money. He also said Wilson has denied him access to the Ark website, and Rolling Stone reports that Wilson recently hired his own lawyer.

Black, meanwhile, seems to be looking forward even as she contends this past deal; she recently signed with L.A.-based DB Entertainment Group.

After Miley Cyrus made a sneaky insult to Rebecca Black and Justin Bieber, Rebecca Black has big fat done it back!

She’s a brave gal. It must be a bit tricky knowing that you’re only famous because most 3 year olds could write better lyrics to a song you sang on YouTube.

“Watching Justin Bieber become so big when he was so young was insane,” said Rebecca.

“I never thought I could be anything like him, and now people are comparing me to him!”

Rebecca seems proud of the way she became famous, and pointed out that some people have “a little jump start in the business, like Miley Cyrus.”

It’s being widely reported Rebecca Black is recording a second single titled “LOL,” but her manager tells us that’s not true!

Many sites are reporting Rebecca Black isn’t wasting any time getting back into the studio and producing more music! Entertainment Weekly is claiming the 13-year-old Internet sensation is riding her 15 minutes of fame and is getting ready to drop her second single titled “LOL,” but apparently, that’s not the case at all!

“Rebecca does not have a new single titled, ‘LOL,’” her manager tells HollywoodLife.com, adding, “Just to be clear she does not have any new single recorded at this time.”

Her rep also clarified another rumor, saying, “We are not working with Flying Pig Productions, they are good people and have wonderful studios — but we have no business arrangement with them.”

Coincidentally (or not), Miley Cyrus — who has publicly bashed Rebecca’s music — is also starring in a film called LOL, so we couldn’t help but LOL at the irony of it all.

Since Rebecca’s first single and music video, “Friday,” became the number one parodied song on the web a couple weeks ago AND made her a millionaire, she’s supposedly been busy in the study prepping to churn out more gems. We can only hope they are just as LOL-worthy as the first one…

Do YOU think she’ll be able to strike lightning twice?

Rebecca Black has suggested that it’s no longer possible for her to have a normal adolescence.

The 13-year-old singer released her debut single ‘Friday’ earlier this month, drawing criticism from some YouTube users and praise from entertainers including Lady GaGa.

Speaking to Us magazine, the musician contended that she is worried about the prospect of attending school now that she’s become an internet phenomenon.

“I wouldn’t say I can be normal at school anymore,” Black said. “People recognize me so much more.”

She continued: “People who I’ve never met before are saying hi to me in the halls. I’ve definitely gotten a lot more well known around my school.”

Despite gaining global fame in a short period of time, Black insisted that she still tries to take time out of her busy schedule to hang out with her friends.

“I’m still just a 13-year-old that has best friends, and I still get to hang out with them and be who I was before this all happened,” she said.

Rebecca Black has said that her critics have inspired her to work on a follow up single to the viral smash ‘Friday’ and that an album could be a possibility too.

‘Friday’ was branded the worst song of all time when it hit internet fame earlier this month with over 50 million people watching the video on YouTube. However, with the views came the comments, some of which were less the complimentary.
Those nasty nancies however have inspired Rebecca to prove to the world that she is more than just ‘Friday’ and is now busy recording a second single called ‘LOL’.

Speaking to The Sun about her critics, Rebecca said: “You think you are bringing me down and making me not want to do this any more. But you’re making me stronger and want to do it even more.

“Here I am in a studio working on my debut album. I’m going to prove you wrong. Just like Friday, the new songs are pretty catchy.”
Rebecca also spoke about how happy she was with the celebrities who have mentioned Friday online including Katy Perry, Nick Jonas, Nicole Richie, Simon Cowell and Justin Bieber.

Asked for a final comment for her critics, Rebecca added simply: “They can try to rain on my parade but as far as I’m concerned they are raining on their own parade”

Viral sensation Rebecca Black says she will donate part proceeds of her song ‘Friday’ to assist the Japanese relief efforts.

In an interview with US Magazine, Rebecca Black said that 40% of the proceeds from sales of her song ‘Friday’ will go to Ark. “I feel bad. Japan happened so close to mine (success), and I feel like I’m taking away attention from it. I really just want to give back”.

Since the ‘Friday’ song went on YouTube just a few weeks ago it has already generated around 60 million views. 13-year old Rebecca says that means her days of being a normal school kid are over. “I wouldn’t say I can be normal at school anymore,” she says. “People recognise me so much more. People who I’ve never met before are saying hi to me in the halls. I’ve definitely gotten a lot more well known around my school”.

As of today (March 28, 2011), ‘Friday’ had generated 59,196,721 views on YouTube.

We can still remember the day we first heard Friday. It was a Wednesday, you know that day before Thursday? We honestly can’t imagine our life without Rebecca Black now.

And the singer is definitely ambitious when it comes to her career. She’s been speaking to Teen Vogue and she only reckons she sounds like country superstar Taylor Swift. She said “People tell me I sound like Taylor Swift. Once you hear my sound without any adjustments—just my raw voice—it’s unique.” Well she’s certainly confident in her own abilites we’ll give her that one.

Does this mean she may be musically inclined to go a little bit country with her sound? We honestly cannot wait to see what she does next!

What do you think? Reckon Rebecca sounds a little bit like Taylor? Whose voice would you liken hers to?
